Terms of Use (TOU)

This Terms of Use (“TOU”) is published by PayoutKart hereinafter referred to as “Company” or “PayoutKart,” which term, unless repugnant to the context or meaning thereof, shall include its directors, employees, and associates. This TOU governs the use of the PayoutKart website, accessible at www.payoutkart.com (the “Website”), by persons downloading, signing up, or registering on the Website and utilizing the financial services offered by the Company (“User”). The TOU should be read in conjunction with the Privacy Policy available on the Website.

Consent and Acceptance

By accessing or using the Website, Users agree to be bound by this TOU and the Privacy Policy. Users represent and warrant that they are 18 years or older and legally competent to enter into a binding agreement. If a User disagrees with any part of this TOU or intends to withdraw consent, the User must immediately cease using the Website. Any withdrawal of consent must be communicated to the Grievance Officer as specified in the Privacy Policy.

This TOU constitutes a legally binding agreement under the provisions of the Indian Contract Act, 1872, the Information Technology Act, 2000, and relevant rules.

Prohibited Activities

Users shall not:

  1. Publish, host, display, upload, modify, transmit, post, or share content that:
    • Belongs to another person without authorization.
    • Is harmful, harassing, defamatory, obscene, invasive of privacy, or otherwise unlawful.
    • Encourages money laundering, gambling, or violates applicable laws.
    • Contains software viruses or harmful codes.
    • Promotes enmity between groups or incites violence.
    • Constitutes unsolicited messages (spam).
  2. Use tools or mechanisms (e.g., robots, spiders, intelligent agents) to hack, reverse engineer, or navigate the Website in unauthorized ways.

User Obligations

  1. Responsibility for Information: Users are solely responsible for understanding the features, terms, and benefits of financial products accessed through the Website. The Company shall not be liable for any loss incurred by the User due to misunderstanding or misuse.
  2. OTP Security: Users must not share their One-Time Passwords (OTPs) with third parties. Users acknowledge that personal information is provided voluntarily.
  3. Transactions: Users must ensure all transactions are legitimate and verify details before transferring funds to any financial institution or third party.
  4. Compliance: Users agree to comply with all applicable laws and exercise due diligence while using the Website.

Disclaimer and Limitation of Liability

  1. The Company publishes information on the Website on an “as-is” basis. While the Company endeavors to ensure accuracy, it does not provide warranties regarding the correctness, reliability, or completeness of any information.
  2. The Company shall not be liable for:
    • Loss of data or technical issues with the Website.
    • Third-party content or actions of financial institutions.
    • Indirect, special, incidental, or consequential damages exceeding INR 1,000.
  3. The Company reserves the right to modify, transfer, or discontinue the Website or its services without prior notice.

Reporting Violations

Users can report any content that infringes intellectual property rights or violates laws by contacting the Grievance Officer detailed in the Privacy Policy. The Company will take action in accordance with applicable law.

Indemnity

Users agree to indemnify and hold harmless the Company, its directors, employees, and associates from any claims, damages, or losses arising from:

  1. User actions violating this TOU, the Privacy Policy, or applicable laws.
  2. Misuse of the Website or its services.

Dispute Resolution and Governing Law

  1. This TOU shall be governed by the laws of India.
  2. Any disputes shall be resolved through arbitration by a sole arbitrator appointed by the Company. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, and the venue shall be Bangalore, India. Courts in Bangalore shall have exclusive jurisdiction for enforcement or interim relief.

Miscellaneous

  1. If any provision of this TOU is deemed invalid, the remaining provisions shall remain enforceable.
  2. Failure by the Company to enforce any right or remedy shall not constitute a waiver of such rights or remedies.
  3. The Company shall not be held responsible for delays or failures caused by force majeure events beyond its control.
  4. Users are responsible for ensuring their access to the Website and compliance with this TOU. Any unauthorized use of a User’s account shall be the User’s responsibility.
